ComputerCut Standard Terms and Conditions of Service
DATABASE ACCESS FEES: Database access included in the Pro-Package is for 12 months (initial term) from date of shipment. To avoid any interruption in database access after the first 12 months, the Dealer is required to contact their Territory Sales Manager to renew the “Database Access Fee” per current published price schedule and purchase qualifications as outlined below. Either the “Preferred” or “Standard” pricing will be charged based on annual Solar Gard film purchases.
PURCHASE QUALIFICATIONS: By purchasing Solar Gard window or paint protection film, Dealer is eligible for a discounted “Database Access Fee” as described here within. “Preferred” pricing is available to Dealers who purchase Solar Gard® Window or Paint Protection Film products in an aggregate annual amount of at least $5,000 USD. If Dealer qualifies for “Preferred” pricing, Dealer understands that preferred pricing is applicable for the following year. Dealer also understand that purchases of the applicable Solar Gard products will be reviewed annually, and minimum purchases are required each year to continue receiving the “Preferred” pricing. Dealer further acknowledges that if Solar Gard purchases fall below the required annual amount, database access fee price will automatically increase to the published “Standard” rates. For ONLY the first year, the required purchase amount will be prorated based on the service date stated on the form.
BILLING: Access fees will be charged to credit card on file on the 20th day of every month or the next business day for the following month access and a billing statement will be mailed. If payment is declined, database access fee must be paid by the last business day of that month, or access will be disabled for the following month. Declined payments will be charged a $29 service fee. If the account is NOT current 60 days after being deactivated, a $249 reactivation fee is required, and new ComputerCut order form completed.
CANCELLATION: Any cancellation request must be emailed to solargardorders@saint-gobain.com by the 15th of the current month. Dealer access will remain active until the last day of that month, no refunds for unused service.
TECHNICAL SUPPORT: Solar Gard will provide a first line of support for our customers on software operation or online troubleshooting for plotters sold by Solar Gard to its customers during the initial warranty period outlined on the ComputerCut order form at the time of purchase.
These Terms may be modified from time to time by Seller, by notice to Buyer. Each such modification shall be binding upon Buyer with respect to all provided services occurring after the date of such modification. No modification or termination hereof or waiver of any of the obligations hereunder by Buyer shall be effective unless in writing and signed by Seller. The failure by the Seller to enforce at any time any of the provisions herein, shall not constitute a waiver and shall in no way be construed as a waiver of such provisions or options, nor in any way be construed to affect the validity of these Terms or any part thereof, or the right of the Seller thereafter to enforce each and every such provision.
